Delta Now Faces 11 Lawsuits After Toronto Plane Crash

ATLANTA- Delta Air Lines (DL) now faces 11 lawsuits over the crash landing of Flight DL4819 at Toronto Pearson International Airport (YYZ) on February 17. The Bombardier CRJ regional jet flipped upside down on a slippery runway, but saw all 80 passengers and crew survived.

Passengers claim “extreme injuries,” citing negligence by Delta and its subsidiary, Endeavor Air (4N). Legal filings reference the Montreal Convention, which governs airline liability during international flights.

Delta Faces 11 Lawsuit

The crash of Flight DL4819, which originated from Minneapolis to Saint Paul International Airport (MSP), has become the center of mounting legal actions against Delta Air Lines (DL).

The lawsuits allege that the airline bears responsibility under the Montreal Convention, a treaty that holds carriers liable for injuries suffered during international flights.

Some cases go further, citing Delta for negligence and pointing to a pattern of operational failures that allegedly contributed to the incident.

Among the plaintiffs is Marthinus Lourens, who claims he was drenched in jet fuel and suffered injuries to his head, neck, and back while hanging upside down in the cabin.

Another passenger, Hannah Krebs, states in her complaint that she was violently tossed around when the aircraft overturned, resulting in physical trauma.

Reported by PYOK, the lawsuits collectively describe what plaintiffs call an “extensive litany of errors and omissions” on Delta’s part, both before and during the flight’s landing attempt.

Delta’s Legal Defense

Delta is seeking to consolidate all lawsuits into a single jurisdiction, specifically the US District Court in Minnesota, where the flight originated.

In its court filing, Delta’s legal team argued that Minnesota presents the “most substantial connections” to the incident for US legal proceedings. The aim is to centralize pre-trial hearings and reduce procedural delays.

Despite the mounting legal pressure, Delta has denied all claims of responsibility. Its attorneys stated that the airline does not accept liability for injuries sustained during the crash.

However, Delta has acknowledged the likelihood of additional lawsuits being filed by other Flight 4819 passengers in the coming months.

Ongoing Investigation

The Transportation Safety Board of Canada (TSB) continues to investigate the crash. In its preliminary report released in March, the board identified 11 key areas requiring deeper analysis.

These include aircraft wing integrity, landing gear functionality, pilot training adequacy, and landing technique.

Notably, the CRJ’s right wing and tail were completely torn from the fuselage as the aircraft skidded across the icy surface. The plane remains in storage for forensic examination.

The report also revealed that the cockpit door jammed shut upon impact, trapping the pilots inside.

A passenger eventually rescued the flight crew through an emergency escape hatch, underscoring the chaos during evacuation.

Amid public scrutiny, Delta had to disclose verified records of the pilots’ experience after inaccurate reports began circulating online.
